What penalties do I face for a robbery conviction?

Any taking of personal property in possession of another in their presence against their will and accomplished by force or intimidation constitutes robbery in California. Robbery charges come in first and second degrees.

Your charges can be enhanced if any of the following factors are present:

  • Causing the victim great bodily injury can add 3 to 6 years in prison
  • Use of a firearm during a robbery can add 10 years in prison
  • If the firearm is intentionally discharged during a robbery, another 20 years may be added
  • If the discharged firearm causes great bodily harm to another, 25 years may be added

In general, a first degree robbery charge is punishable by up to 6 years in prison while a second degree conviction carries up to 5 years in state prison.

The Aggressive Legal Defense You Deserve

The prosecution will need to prove several points to obtain a robbery conviction—that you took someone’s property while they were present using intimidation. If any one of these points can be called into doubt, the prosecution‘s case could fall apart and you would go free.

Our Visalia criminal defense lawyer can argue that your charges are the result of some misunderstanding. Otherwise, we can push for a probation sentence rather than prison time. You can trust our firm to work towards the best possible resolution of your case at all times.
