What penalties do I face for a robbery conviction?

 

Any taking of personal property in possession of another in their presence against their will and accomplished by force or intimidation constitutes robbery in California. Robbery charges come in first and second degrees.

Your charges can be enhanced if any of the following factors are present:

 

  • Causing the victim great bodily injury can add 3 to 6 years in prison
  • Use of a firearm during a robbery can add 10 years in prison
  • If the firearm is intentionally discharged during a robbery, another 20 years may be added
  • If the discharged firearm causes great bodily harm to another, 25 years may be added

 

In general, a first degree robbery charge is punishable by up to 6 years in prison while a second degree conviction carries up to 5 years in state prison.
